Membership Terms & Conditions

General

All members must comply with club policies & procedures or membership may be suspended or terminated upon discretion of LivFit.

Freezes

  • For all freezes, member must notify via email only — no in-person requests accepted. Email livfitarlington1@gmail.com. Freezes only start on the 1st of the month; notification must be at least 2 weeks before the last day of the month prior to the freeze month(s).
  • Automatic Payment memberships — 2 monthly freezes allowed per year, $15 monthly fee
  • Paid in full 6-month and 12-month memberships — 3 monthly freezes allowed per year, $15 monthly fee
  • Student memberships (pre-paid 6-month) — 2 monthly freezes allowed per year, $15 monthly fee

Refunds

  • All sales are final, except as required by Massachusetts General Laws health club policy.
  • Massachusetts General Laws Title XV Chapter 92, Section 81 — 3-day cooling off period: member can cancel for any reason without penalty and is entitled to a refund up to three days after joining date, paid within 15 days from date of cancellation. Must be submitted in person and in writing, or sent to 471 Massachusetts Avenue, Arlington MA 02474 via certified or registered US mail. Refund will be for the unused time of membership.
  • Pre-Paid Memberships — Chapter 93, Section 82: no-penalty prorated refund for unused time is available due to health concerns/injury (requires physician's note), inability to use the facility for more than three months, relocation where home or place of employment is greater than 25 miles away, death (your estate may cancel your membership), or LivFit closing permanently or significantly altering operations.

Cancellations

  • Cancellation is only allowed via our website www.livfitarlington.com where there is a specific prompt for this action. Please do not email cancellations, as we cannot guarantee a timely response and action.
  • $30 fee if 6-month commitment is not completed for Automatic Payment Memberships

Student Memberships

  • Membership available for Middle School / High School students ages 13–19
  • Must present valid school ID (Middle School / High School) at time of joining
  • Under age 18, parent or guardian must sign club waiver in-person

Checking In

  • All members must check in upon entry to the facility, no exceptions
  • Please scan your key card each time you enter the club, as this improves security by distinguishing you from non-members
  • Your active key tag or mobile entry app may not be loaned to another person. Allowing someone else to use your key tag will result in immediate termination of your membership.
  • Security cameras with recording capabilities are in use at LivFit

Locker Rooms

  • Our locker rooms have lockers for you to store your belongings while you work out. You must bring your own lock. Self-service lock boxes for valuables are also available for one-day use. LivFit is not responsible for damaged, lost, or stolen items.
  • LivFit maintains a Lost and Found. Found items are kept for approximately 14 days. We are not responsible for lost, stolen, or damaged personal property, including but not limited to any property left on the premises or in a locker.

Smoking Prohibited

  • LivFit is committed to the health of its employees and members. Smoking is not permitted anywhere in LivFit, including all enclosed areas of the gym and the entrance area immediately outside the front door. This applies to all smoking tobacco products — cigarettes, cigars, pipes — and any vaping products.

Workout Attire

  • Proper athletic attire must be worn while on the LivFit premises and using the equipment and services
  • Sneakers, socks, athletic pants/shorts, and shirts are considered appropriate attire
  • Jeans are not permitted
  • Bare feet, socks only, or sandals are not permitted
  • If available, during winter months and rainy days, please bring a dry pair of shoes

Food & Beverages

  • Other than water bottles and sports drinks, all other types of food and beverages are not allowed in the workout areas of the gym
  • We offer a selection of sports drinks and protein bars at the front desk for purchase

Health & Safety

  • If you have COVID, the flu, a cold, or any other contagious illness, please do not use the gym. Using the gym with a contagious illness puts you and all other members at risk. Illness causes an individual's system to become weaker and the likelihood for injury increases significantly when training under these conditions. Furthermore, given the nature of physical training, the transmission of contagious diseases occurs quite readily.
  • Bottles of disinfectant spray and paper towels are available throughout the gym for cleaning perspiration from the pads and benches. Please be courteous of fellow gym members and use the supplies provided in the areas that you use.

Injuries

  • Any member who incurs an injury or becomes dizzy/ill while using the gym should immediately contact a staff person for assistance. A first aid kit is kept at the front desk for minor injuries. In cases requiring more extensive first aid, fitness center staff will contact local emergency 911 assistance. It is important that fitness center staff be notified of any cases of injury or illness so that proper procedures can be initiated.

Cardiovascular Equipment

  • Cardio equipment is on a first come, first serve basis. We ask that you please limit cardio use to 30 minutes per session if other members are waiting. Our desk staff can assist you if you have any questions or concerns. Please wipe down cardio equipment after use.

Weight Lifting Policies

  • For the courtesy of all gym members and for safety reasons, all users MUST re-rack their own dumbbells and weight plates after they have finished using them. Searching for sets of weights needed for your program can be a hassle and this is easily avoided when all lifters re-rack their own weights. Furthermore, having weights spread throughout the center poses obvious hazards. Continued failure to abide by this policy may lead to the suspension or termination of your membership.
  • Please do not slam or drop the weights
  • No lifting chalk allowed anywhere in LivFit
  • Please use a spotter when necessary

Fire Alarms

  • Whenever a fire alarm is sounded, immediate evacuation of the building is the appropriate response. If there is a fire alarm while you are using the facilities, you must immediately leave the facility through the nearest exit door and remain outside until it has been announced that it is safe to enter. Front and rear of the building have emergency exit doors.

Mobile Phone & Camera Use

  • Please be courteous of all other members and try to limit using cell phones while working out. This will help prevent "back up" on machines and free weights. Additionally, please limit phone calls to common areas.

Inclement Weather

  • Every possible effort will be made to keep the gym open during normal operating hours in the event of poor weather conditions. Should modifications need to be made to our hours, notification will be emailed to all members with updated email addresses in our database and/or posted on our website at www.livfitarlington.com. Please keep in mind that on occasion inclement weather causes power outages and updating our website may not be possible. Therefore, please call the gym prior to venturing out during a bad storm to verify that it is open or the class you want to take is indeed happening.

Waiver of Liability

In addition to and complementing the waiver signed during membership sign-up.

  • The health and safety of our members and guests is our highest priority. While our policies are designed to help protect you, LivFit cannot remove all risk or otherwise guarantee that you will not sustain any injuries or damages from your workout, or contract any viruses, communicable diseases, or other health hazards associated with your use of LivFit's premises, facilities (including our outside property), equipment, services, restrooms, and activities. We are not liable for inherent common risks stemming from your use of fitness classes, fitness equipment, and/or personal training.
  • Acknowledgement of Risk and Voluntary Participation: Members understand and acknowledge that participation in any activity at LivFit — including but not limited to open gym, group classes, personal training, strength sports, and virtual sessions — involves inherent risks. Participants engage in these activities with full knowledge of these inherent risks and voluntarily accept and assume all such inherent risks as a condition of entry, presence, or participation. Inherent risks include but are not limited to:
    • Physical Injury: Risks of strains, sprains, fractures, dislocations, concussions, musculoskeletal injuries, and other adverse physiological responses, including fainting, arrhythmia, shortness of breath, chest pain, rapid heart rate, heart attack, stroke, and any other physical injury.
    • Equipment & Facility Use: Risks associated with equipment malfunction, personal error or misuse of equipment, or injury from contact with other equipment or training surfaces, including uneven or slippery surfaces.
    • Actions or Omissions of Others: Risks arising from the conduct, negligence, or inattention of other participants, staff, guests, or third parties, including during supervised or unsupervised activities.
    • Environmental & Health Factors: Risks related to weather conditions, heat, humidity, communicable diseases, or the aggravation of any pre-existing medical condition, whether disclosed or not.
  • All active members are required to sign in person or agree electronically to our formal liability waiver during membership sign-up. If you need a copy, please email us or stop by the front desk. The waiver agreement is not intended to waive any statutory rights you may possess under Massachusetts law, including the right to bring a claim arising from the gross negligence or willful misconduct of LivFit LLC, its employees, or agents.

The preceding policies and procedures are not all-inclusive. Other rules and regulations may be posted in and about the facility and shall be binding for all members. Ownership/management reserves the right to change and amend these policies and procedures as deemed necessary, and upon any changes or revisions we will notify all active members via email as well as post updates on our general posting bulletin board.
